Welcome to Spirit Sense. By using our app, you agree to these terms. If you don't agree, please don't use the app. We've kept these as clear and straightforward as possible.
1. Age Requirement
You must be at least 17 years old to use Spirit Sense. The app provides information about alcoholic beverages and is intended for adults. By creating an account, you confirm that you meet this age requirement.
2. What Spirit Sense Does
Spirit Sense identifies spirits from photos or name searches and provides AI-generated sensory profiles, production details, food pairings, and cocktail suggestions. You can save spirits to a personal collection and track what you've explored.
3. AI-Generated Content
All spirit profiles, tasting notes, production details, food pairings, and cocktail recipes are generated by artificial intelligence. This content is for entertainment and educational purposes only. It is not professional advice from a sommelier, distiller, or medical professional. AI-generated information may contain inaccuracies.
- Do not rely on Spirit Sense for medical decisions, including decisions about alcohol consumption.
- ABV (alcohol by volume) figures are approximate and sourced from AI. Always check the bottle label for the actual ABV.
- Food pairing and cocktail suggestions are creative recommendations, not dietary or allergy advice.
4. Your Account
- You sign in through Google or Apple. We don't manage passwords.
- You're responsible for keeping your device and account secure.
- You can delete your account at any time from Settings in the app. Deletion is permanent and removes all your data.
5. Free and Pro Tiers
Free tier: 5 photo scans and 20 profile lookups (lifetime). Share the app to earn 5 bonus profile lookups.
Pro tier ($4.99/month or $44.99/year): Unlimited photo scans, unlimited profile lookups, and unlimited collection size.
6. Subscriptions
- Pro subscriptions auto-renew at the end of each billing period (monthly or annually) unless you cancel.
- Cancel anytime through your device's subscription settings (iOS: Settings > Apple ID > Subscriptions; Android: Google Play > Subscriptions).
- When you cancel, you keep Pro access until the end of your current billing period.
- Refunds are handled by Apple (App Store) or Google (Play Store) according to their respective refund policies. We cannot process refunds directly.
- Prices may change. We will notify you before any price increase takes effect on your subscription.
7. Acceptable Use
Spirit Sense is for personal, non-commercial use. You agree not to:
- Scrape, crawl, or systematically extract data from the app or its APIs.
- Use automated tools, bots, or scripts to interact with the app.
- Reverse engineer, decompile, or attempt to extract the app's source code.
- Abuse free-tier limits by creating multiple accounts.
- Use the app for any illegal purpose.
We reserve the right to suspend or terminate accounts that violate these terms.
8. Intellectual Property
- Our content: The Spirit Sense app, brand, design, and AI-generated spirit profiles are our property (or licensed to us). You may not reproduce or distribute them without permission.
- Your content: Spirits you save to your collection remain yours. By using the app, you grant us a limited license to store and display your collection data to provide the service.
- Spirit brands: Spirit names, brands, and distillery names referenced in the app are trademarks of their respective owners. Spirit Sense is not affiliated with or endorsed by any spirit brand.
9. Limitation of Liability
To the maximum extent permitted by law:
- Spirit Sense is provided "as is" without warranties of any kind, express or implied.
- We are not liable for any decisions you make based on AI-generated content, including decisions about alcohol consumption, food pairings, or purchases.
- We are not liable for any indirect, incidental, or consequential damages arising from your use of the app.
- Our total liability to you shall not exceed the amount you paid us in the 12 months preceding the claim.
10. Privacy
Your privacy matters. Please read our Privacy Policy for details on how we collect, use, and protect your data.
11. Changes to These Terms
We may update these terms from time to time. If we make significant changes, we will notify you through the app or by email. Continued use of the app after changes constitutes acceptance of the updated terms.
12. Governing Law
These terms are governed by the laws of the United States. Any disputes will be resolved in accordance with applicable law.
